الاستدلال بالسنة يتطلب أمرين:
الأول: التأكد من صحة نسبتها إلى النبي (صلى الله عليه وسلم)؛ لأن كثيراً من الأحاديث الضعيفة والموضوعة قد دُسَّت في السنة زوراً.
لذلك، فقد ألف العلماء كتباً في الرواة وكتباً في المصطلح للتمييز بين الحديث الصحيح وغير الصحيح.
الثاني: كحال القرآن، من المهم مراعاة أن يكون هناك تطابق بين دلالة الحديث المستدل به والحكم الذي يُستدل له بهذا النص. والناس متفاوتون في هذا تفاوتاً كبيراً، وقد قال الله تعالى للنبي (صلى الله عليه وسلم):
{وَأَنْزَلَ اللَّهُ عَلَيْكَ الْكِتَابَ وَالْحِكْمَةَ} [سورة النساء: 113].
وقد ذكر كثير من العلماء أن "الحكمة" هي السنة.
